Senate: The Senate continued processing nominations. They began consideration of the Fiscal Year (FY) 2026 National Defense Authorization Act (NDAA). The Senate failed to reach the 60-vote threshold to pass legislation to address the expiring Affordable Care Act (ACA) subsidies.

 

House: The House passed the FY26 NDAA. They passed the PERMIT Act (H.R.3898), the Electric Supply Chain Act (H.R.3638), the State Planning for Reliability and Affordability Act (H.R.3628), the INVEST Act (H.R.3383), and the Improving Interagency Coordination for Pipeline Reviews Act (H.R.3668).

 

Trump Administration:  On December 11, President Trump signed an Executive Order entitled, Protecting American Investors from Foreign-Owned and Politically-Motivated Proxy Advisors. The Order aims to limit the impact proxy advisors that prioritize “radical” political agendas over investor returns.  

 

Next week in Washington 

 

Senate: The Senate will reconvene Monday, December 15 and is expected to continue consideration of the FY26 NDAA and continue processing nominations including the next en bloc package of nominees.

 

House: The House will reconvene Monday, December 15 and is expected to consider the SPEED Act (H.R.4776), the Mining Regulatory Clarity Act (H.R.1366), the Reliable Power Act (H.R.3616), the Power Plant Reliability Act (H.R.3632), the Kayla Hamilton Act (H.R.4371), and the Pet and Livestock Protection Act (H.R.845). They could also consider a health care package to address the expiring ACA subsidies.
